1. Acceptance of Terms

By accessing or using EDMFeedback ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and the operator of EDMFeedback ("we", "us", "our"), an individual operator based in Norway. By creating an account or using the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

EDMFeedback provides AI-powered audio analysis and feedback for electronic music producers. The Service:

• Accepts WAV and AIFF audio file uploads for analysis
• Performs technical audio analysis using browser-based and server-side processing
• Sends anonymised technical measurements (not audio content) to an AI language model
• Returns written feedback on technical quality, arrangement, and production
• Stores feedback text (not audio) in your account history

3. User Accounts

To access certain features you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account
• Not create accounts using automated means or under false pretences

We reserve the right to suspend or terminate accounts that violate these Terms, show signs of abuse, or engage in fraudulent activity.

4. Acceptable Use — What You May Upload

You must own or have rights to all uploaded material

By uploading audio to EDMFeedback, you represent and warrant that:

• You are the original creator of the audio, OR
• You hold a valid licence that permits you to submit the audio for analysis, OR
• The audio is in the public domain

You must NOT upload audio that you do not own or have rights to, including but not limited to: commercially released tracks you purchased but did not create, samples you do not have a licence for, or other people's recordings without their permission.

Prohibited content and uses

You agree not to use the Service to upload, analyse, or process:

• Audio containing illegal content of any kind
• Content that violates any third party's intellectual property rights
• Audio recordings of private conversations without all parties' consent
• Content designed to harass, defame, or harm any individual
• Content that violates any applicable law or regulation

You also agree not to:

• Use automated scripts or bots to submit analyses in bulk
• Attempt to reverse engineer, circumvent, or abuse the credit system
• Share account credentials or allow others to use your account
• Attempt to access, extract, or replicate our AI prompts or analysis methodology
• Use the Service in any way that could damage, overload, or impair our infrastructure
• Resell or commercially exploit the Service without our written permission

5. Our Liability for Audio Files — Safe Harbour

EDMFeedback operates as a passive conduit for audio analysis. We do not:

• Store uploaded audio files
• Listen to, copy, or distribute your audio
• Have editorial control over what audio is uploaded
• Transmit your audio to any third party

Because audio files are immediately deleted after analysis and are never stored, transmitted, or made accessible to third parties, we believe our liability exposure for copyright infringement by users is extremely limited under both EU Directive 2019/790 on Copyright in the Digital Single Market and applicable international copyright frameworks.

Nevertheless, if you believe content uploaded through our Service violates your intellectual property rights, please contact us at [email protected] and we will investigate promptly.

6. AI-Generated Feedback — What This Service Is and Isn't

How the feedback is generated

EDMFeedback is not a simple AI chat tool. Your track goes through a multi-stage analysis pipeline before any feedback is written:

• Acoustic analysis — measures BPM, key, loudness (ITU-R BS.1770-4), true peak, dynamic range, stereo width, frequency balance, and over 20 additional technical parameters
• Machine learning musicality models — trained ML models assess musical characteristics such as energy, groove, drive, and mood profile, calibrated per genre
• Genre intelligence — measurements are benchmarked against real-world genre targets to contextualise the results
• Claude (Anthropic) — a large language model that interprets the full set of measurements and writes the feedback report

This combination of signal-based measurement and AI interpretation means the feedback is grounded in real technical data — not generated from the track name or genre label alone. All automated analysis has inherent limitations. Results are best-effort estimates based on mathematical measurements of your audio file.

What the feedback cannot guarantee

You acknowledge and agree that:

• Technical measurements are mathematical approximations — they reflect what can be measured, not how music sounds or feels to a human listener
• BPM, key, and frequency readings may occasionally be incorrect, particularly on complex or unconventional productions
• AI-generated feedback may contain inaccuracies, miss important aspects of your track, or give suggestions that don't apply to your specific creative vision
• Label suggestions are illustrative only — they are based on genre and technical profile matching, not relationships with labels, and carry no weight or affiliation whatsoever
• Following the feedback does not guarantee commercial success, label interest, playlist placement, or any other outcome
• The "A&R Verdict" is a fictional persona — it is AI-generated text styled as personal feedback, not an assessment from a real A&R professional
• Genre benchmarks are based on published research and measured professional releases — individual taste and artistic intent may intentionally deviate from these benchmarks
• No automated tool can fully replace the judgment of an experienced music producer, mixing engineer, or A&R professional

How to use this feedback well

EDMFeedback works best as a starting point for your own critical thinking — a second opinion that highlights things worth considering, not a definitive verdict. Use it alongside your own ears, trusted peers, and professional feedback when you can get it. The goal is to help you ask better questions about your music, not to replace your creative judgment.

7. Payments and Subscriptions

Paid plans are processed through Stripe (stripe.com), one of the world's most trusted payment processors. By subscribing you agree to Stripe's terms of service in addition to these Terms. Stripe is PCI DSS Level 1 certified — the highest level of payment security certification.

• Billing: Subscriptions are billed monthly in advance
• Cancellation: You may cancel at any time through the billing portal on your dashboard, or by emailing [email protected]. Cancellation takes effect at the end of the current billing period — you keep access and credits until then
• Refunds: We do not offer refunds for partial months or unused credits, except where required by applicable consumer protection law
• Credit rollover: Unused monthly credits do not roll over to the next month, except for Studio plan users
• Price changes: We will give at least 30 days notice before changing subscription prices

EU/EEA consumers: Under EU consumer protection law, you have a 14-day right of withdrawal from new subscriptions. This right is waived once you have used any credits in that period, as the digital service has been partially performed at your explicit request.

8. Intellectual Property

Your music: You retain full ownership of all audio you upload. We claim no rights over your music or any feedback generated about it.

Our Service: EDMFeedback, including its design, code, algorithms, prompts, and brand, is our intellectual property. You may not copy, reproduce, or create derivative works from our Service without written permission.

Feedback text: The written feedback generated for your tracks is stored in your account and is yours to use. You may share it freely. We may use anonymised, non-identifiable feedback patterns to improve our service.

9. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service you consent to the data practices described there.

In summary: we collect your email address and analysis history. We do not store audio files. We comply with GDPR as implemented in Norwegian law.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

EU/Norwegian consumers: The above limitations do not apply to liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. Norwegian consumer protection law (forbrukerkjøpsloven) may give you additional rights.

11. Indemnification

You agree to indemnify, defend, and hold harmless EDMFeedback and its operator from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your upload of content you do not have rights to
• Your violation of any third party's rights
• Your violation of any applicable law

12. Service Availability and Modifications

We do not guarantee uninterrupted or error-free service. We reserve the right to:

• Modify, suspend, or discontinue the Service with reasonable notice
• Update these Terms at any time — we will notify registered users by email at least 14 days before material changes take effect
• Change pricing with at least 30 days notice
• Terminate accounts that violate these Terms

Continued use of the Service after changes to these Terms constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Norway. For users in the EU/EEA, you also benefit from any mandatory consumer protection provisions of your country of residence.

We aim to resolve disputes informally. If you have a complaint, please contact us at [email protected] first. If we cannot resolve the dispute informally:

• Norwegian users: You may bring disputes before the Norwegian Consumer Authority (Forbrukertilsynet) or the Consumer Disputes Commission (Forbrukertvistutvalget)
• EU users: You may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
• Other users: Disputes shall be subject to the exclusive jurisdiction of Norwegian courts
